Here is the current status of the case between Marple Twp and PECO at the PUC***
On December 8, 2021, ALJ DeVoe delivered her Initial Decision in this matter, and her decision was totally in PECO's favor. Marple Twp. and other parties filed exceptions to the decision, which will be reviewed by the full Commission. The Final Decision of the Commission may agree, disagree, or come up with some other solution that is somewhere in the middle (date unknown). Now, at the end of January, 2022, the deadline for Exceptions has passed, and there is not much to do at this point except to wait for the full Commission to make a final ruling. Assuming that the Final Decision is in our favor is great, but, assuming that the Final Decision is not in our favor leads to the question of appealing the Final Decision to the next level, which is the Commonwealth Court. If the Final Decision is against us, and Marple Twp. does not move forward with an appeal, then the game is over.
