An Environmental Review of a PUC Infrastructure Project
Certainly, for the residents of Marple Township, the most crucial aspect of this affair is that the Location of PECO's proposed Gas Expansion Plant at the Corner of Sproul and Cedar Grove Roads is NOT REASONABLE. However, this case has recently taken on a greater level of consequence that makes it an important issue for the entire state of Pennsylvania. On March 19, a seven member panel of PA Commonwealth Court Judges unanimously decided that the PUC had erred in its decision to allow the PECO project to move forward, and remanded the case back to the PUC, ordering that the commission issue an Amended Decision which must incorporate the results of a constitutionally sound environmental impact review... "
A constitutionally sound environmental impact review has never before, in Pennsylvania, been ordered for a public utility infrastructure project, and this case (and/or the following appeal to the Commonwealth Court) will determine what such a review will look like.
