Filing prehearing memoranda is not a “prerequisite” to attending the conference. All proceedings with the Commission are technically open to the public. ALJ Devoe's Prehearing Conference Order, like the one ALJ Devoe issued the first time around, directs parties to file prehearing memoranda so ALJ Devoe has an idea of where the parties stand (and they all know where everyone else stands) on prehearing issues and we can all can better prepare for the conference. The direction to file and the filing of prehearing memoranda is standard practice in all major cases at the Commission. You will not be barred from attending or participating in the conference if you do not file prehearing memoranda, but consider it an opportunity to communicate with ALJ Devoe and the other parties regarding the issues identified in the Prehearing Conference Order prior to the conference.
Protestants do not need to refile protests if they filed protests the first time around.
As for additional protests filed by individuals or businesses who did not file protests the first time around, they must follow the Commission’s rules regarding the filing of protests and, if any are filed, ALJ Devoe will consider them according to the Commission’s rules.

The last time we attended a public Pre-Hearing Conference, the Marple Township residents represented really well! We now are invited once again to a Pre-Hearing Conference. Our strong attendance will be important to let the PUC know that the residents of Marple Township have not forgotten about this issue or given up. At that time, topics included the schedule, public hearings, possible visitation to the site by the judge, and so on. This PHC will probably also consider what will happen in the environmental impact review. Such a review has never before been ordered for a “619 procedure”, so it will be interesting to see what happens.
The public in general will probably not be expected to speak at this hearing. However, our strong attendance will be important to let the PUC know that the residents of Marple Township have not forgotten about this issue or given up. If you want to file a Pre-Hearing Memorandum, you can look at some of the PHMs that were used last time, and update them accordingly. Old PHMs can be found on the PUC website.
